July 2010: Another drama has been seen in the premises of Supreme Court (SC)
Ram Shah Path, when a writ has filed against withdrawal of the action to elect
UML chairman Jhala Nath Khanal to the post of Prime Minister at the legislature
parliament.
Member of UML
legal department, Kumar Aacharya and Bhabishwar Gurung, filed a joint petition
claiming the withdrawal of the motion is illegal. Firstly, incumbent Prime
Minister cannot become a proposer for the post of PM, mentions the writ. Secondly,
the proposal cannot be withdrawn once registered.
The petitioners have accused caretaker PM Madhav
Kumar Nepal, who is the proposer of the motion to elect Khanal as the PM, of
withdrawing the proposal with an intention to prolong his duration in office.
They have demanded the previous two elections be
cancelled and candidacy of Khanal be retained at the elections slated for
August 2.
Sources say, UML leader Bam Dev Gautam had lawyers
close to him file the writ petition against the withdrawal of the motion. A
hearing on the case is taking place today.
